Full Version: What are my options?

So here's the situation:

I am driving my car earlier today and was heading to my friends house. I had my windows open and was listening to some song on 97.9 at about 1/3 volume in my car. It had a little bass kick. (I have a sub in my car and its all tuned for quality, not car rattling bass.)

So I turn down a street heading to my friends house and go past a cop that has a car pulled over. He pulls from around that car and pulls me over and says I am getting a $75 ticket for having my stereo too loud as they have had too many high-schoolers with their stereos cranked near the school.

I politely tell the officer that I am not some show-off high schooler with a car rattling system in my car, that I have a system tuned for sound quality and was listening to it at a reasonable level. He said that the law states if he can hear it at 75 feet it is too loud. (He was around the corner by a building and has no idea how far away I was.) I told him that a factory stock stereo could easily be heard at that distance.

He then told me I should have been smart enough to turn it down when I went by a marked squad. To which I replied that I had no reason to turn it down as I did not think I was breaking any law. (Had I happened to turn it down it would have looked as though I was admitting guilt anyway.)



So....... This goes down as an equipment violation and I could still lose my license if I get another ticket in 3 months. I plan on fighting it because it is a BS ticket that is entirely qualitative, not quantitative (ex. set decibel number at set distance). I have a good attorney that we are pretty good friends with if it goes that far. What should my plan of attack be??

FIGHT IT, for some reason i though it was maximum of 2 city blocks that your car can be heard. guess i was wrong

unfortunantly you are screwed in this case, i have even gotten in trouble in crystal lake at a MECA sanctioned event!!!!

FYI your ticket is NOT A MOVING violation, it does not effect your driving record even if you are on supervision, i wouldnt be surprised if it is a City ordinance ticket
He said that it is an equipment violation (like driving without my headlights on) and I believe that it will be counted if I get another ticket?? The thing that I am wondering is that he was around a turn, behind a building and had no idea where I was. I am going to call the attorney today and see what he says. If its worth fighting at all he'll know.
Jeez, home one week and already rasing hell in the neighborhood....settle down, man! What's next? drag racing and keg stands????

Chances are that you could fight the ticket, but it will not be worth it. It is NOT a moving violation, but you can call the phone number on the ticket, speak with the clerk and varify that. You may get lucky in court if you have an attorney and the cop is late and misses it - then its dropped. People with lawyers get to go to the front of the line in traffic court and that has helped me out before.

Hahaha..... I talked to my attorney. He said its really not worth it even though it sounds as though it may go down as a moving violation. He said that for him to go and probably just get me supervision is ridiculous. I am going to get a hold of my Lombard PD connection and see if anything can be done and if not then I'll decide whether I want to go to court or just pay it. (Cutting the line with an attorney is great though. Especially if your last name starts with S and they start at the top of the alphabet.)

Yeah ya definetely want to involve you "connection" on a BS issue like this...Rolleyes
DAN... There is NOTHING they can do after the ticket is written. Trust me... I tried to use the professional courtesy thing after the ticket was written and it was a dead issue...

Yeah, you are right. I decided earlier not to call him. Save it for when I really need it. It's a BS "revenue" ticket but there really is nothing I can do about it. Next time I'll make the ticket worth it.....

I did think about pulling the system out, taking a pic, going to the judge and asking him what the problem was...... Haha
